fa مسئولیت مدنی ناشی از امتناع از درمان بیمار Civil liability Arising from Refusal to Treat a Patient عمومى General مروری Review چکید‌ه زمینه: امروزه یکی از مواردی که سبب نارضایتی مردم و نیز افزایش دعاوی مطروحه علیه صاحبان حرف پزشکی شده است مبحث امتناع از درمان بیمار است. مقصود از امتناع از درمان بیمار هرگونه خودداری از پذیرش و معالجه بیمار از سوی صاحبان حرف پزشکی است . لذا هدف ما از این تحقیق تببین ماهیت و ارکان مسئولیت مدنی صاحبان حرف پزشکی در امتناع از درمان بیمار خواهد بود. مطالعه حاضر سعی دارد تا ضمن بررسی احکام تکلیفی مبنی بر ارائه خدمات درمانی به بیماران، قرائتی نو از مواد قانون مجازات اسلامی در خصوص مبنا قرار دادن تقصیر در مسئولیت ناشی از امتناع از درمان ارائه نماید. روش کار: این تحقیق مطالعه ای کیفی از نوع توصیف و تحلیل محتوا است که مرور ساختار یافته منابع کتابخانه ای شامل اسناد، کتب و مقالات بر اساس کلمات کلیدی امتناع از درمان و مسئولیت مدنی انجام گردید. یافته ها: یافته ها حاکی از آن است که اگرچه امتناع از پذیرش بیمار در برخی از موارد دارای توجیه اخلاقی، قانونی است لیکن در بسیاری از موارد، امتناع از پذیریش بیمار، موجب متضرر شدن وی و در نهایت منتهی به تحقق مسئولیت مدنی ارائه دهنگان خدمات درمانی می‌شود.  نتیجه‌گیری: در صورت تجمیع شروط  فعل زیانبار، حدوث ضرر و رابطه سببیت، امتناع از درمان بیمار نیز  به عنوان یکی از صور تحقق مسئولیت مدنی مدنظر قرار خواهد گرفت. بر همین اساس در شرایط غیر اورژانسی ارائه دهندگان خدمات درمانی تا پیش از برقراری قرارداد معالجه صرفا در قبال برخی از آسیب های وارده بر بیمار مسئولیت مدنی دارند لکن پس از برقراری رابطه مذکور هرگونه امتناع از درمان بیمار موجب  تحقق مسئولیت مدنی صاحبان حرف پزشکی خواهد شد. از سوی دیگر در شرایط اورژانسی امتناع از کمک رسانی به بیمار به عنوان یکی از اسباب ورود ضرر به وی موجب شکل گیری مسئولیت مدنی صاحبان حرف پزشکی می شود و بعلاوه امتناع از کمک موثر، علت تامه ورود ضرر شناخته شده و منتهی به تحقق مسئولیت ارائه دهندگان خدمات درمانی خواهد شد.   Abstract Background: Nowadays, dissatisfaction among people and an increase in lawsuits against medical experts can be traced to the practice of “Refusing to Treat Patients”. The term “Refusal to Treat the Patient” refers to any kind of refusal act in accepting and treating a patient by medical experts. Hence, the present research seeks to elucidate the nature and elements of the civil liability of medical experts when refusing to treat a patient. As an answer to their mental concern, the authors intend to present a new reading of the articles of the Islamic Penal Code regarding the basis of fault in the responsibility of refusing treatment, while examining the mandatory rulings on providing medical services to patients. Methods: Using descriptive and analytical methods, this is theoretical research. The data were also collected from the libraries by referring to documents, books, and articles. Ethical Consideration: The originality and trustworthiness of the content have been observed throughout writing the research. Results: The findings suggest that although in some cases refusal to accept a patient has legal and ethical justifications, in many other cases, however, the refusal to accept a patient leads to hurting them and entails civil liability for the healthcare providers. Conclusion: It is fair to compensate a patient if he or she has been subjected to accumulated tortious acts, suffered serious harm, and has been refused treatment or given a causal relationship. In non-emergency situations and according to the signed pretreatment contract, healthcare providers are only responsible for certain injuries to patients. However, once the contract is signed, any refusal to treat a patient would result in civil responsibility for medical experts. In addition, refusing to treat patients in an emergency situation would be considered harmful to them and subject doctors to civil liability.
