Abstract
Background: AIDS patients require special attention due to their vulnerability. This disease affects not only the life of the individual but also their family. Therefore, to protect their personality and maintain human dignity, these patients necessarily need the support of the legal and judicial system.
Methods: This research is theoretical and the research method is descriptive-analytical. Information was collected through library research and by referring to legal documents, books and articles.
Results: The findings of this study show that although the existing legal and judicial measures are not sufficient to remove the obstacles and challenges of supporting patients with AIDS, the legal and judicial system can be a solution by reforming and completing the legal order, developing appropriate solutions, strengthening judicial practice in this regard, and modeling and utilizing the human rights system in helping to provide mental and psychological peace and reduce the suffering of patients who live with HIV.
Conclusion: The legal and judicial system’s support for patients who live with HIV, due to their specific physical and mental conditions, is of increasing importance in the process of their daily lives and life expectancy. It is necessary for the legal and judicial system to take steps to eliminate the aforementioned legal deficiencies and shortcomings in order to support these vulnerable groups, so that in addition to legal and judicial support, we can witness comprehensive medical, economic, social, and cultural support, and ultimately, support for their personality and human dignity in order to control this disease.
